This equally works with child protective services. CPS investigators are exactly in the position as police officers under the executive branch of government, police are the DEPARTMENT of law enforcement and CPS is the DEPARTMENT of Children and Families (notice they are both Department’s) this is the same for the Department of Finance, Agriculture etc (all of which have an investigative component in their department)

I think you bring up a good point about the case being overturned. I don’t think it’s ever been challenged from this perspective using this type of argument. It could be challenged with a declaratory type action on behalf of disabled persons. I haven’t read the whole case or looked at any subsequent cases that have clarified it further, but it would be very interesting to get the action filed and ask multiple non profit agencies to file an amicus brief in support.
